This is an application under Section 483 of the BNSS, 2023 with prayer for bail of the accused/applicant in connection with Chandmari P.S. Case No. 57/2026 u/s 143(3)/144(2) of the Bharatiya Nyaya Sanhita read with Section 3/4/5(1)(a)/7 of the Immoral Traffic (Prevention) Act, 1956. 3. An FIR was lodged by certain local residents alleging suspicion that illegal activities are allegedly carried out in house no. 9 located at Pub Sarania, Bye Lane-1 (west) in their neighborhood. It was alleged that local residents observed that the said premises is frequently visited by unknown persons at odd hours causing disturbance and creating an unsafe environment in the locality. It was alleged that strong suspicion was there that illegal prostitution and trafficking related activities were being operated from the said house. It was alleged that local residents had noticed that residents of the locality known as Nikhil Das along with Atikur Rahman are managing and facilitating those activities as pimps/operator. It is alleged that on that day i.e. on 25.05.2026, two women were caught red handed in the said premises and one of the accused/persons, namely, Nikhil Das was handed over to the Chandmari police by the local residents. After receipt of the FIR, police registered Chandmari P.S. Case No. 57/2026 under the aforementioned sections. 4. Mr. Ali, the learned counsel for the accused/appellants submits that the accused/applicant did not force anyone to do any immoral activities and since the accused/applicant is behind the bars since last 67 days, he should be allowed to go on bail. 5. Case Diary of the case is produced and perused the same. 6. After perusal of the Case Diary and after prima facie finding sufficient incriminating materials against the accused/applicant’s involvement as narrated Page No.# 3/3 in the FIR, the instant bail application is rejected.
