Petitioners Versus The State of Jharkhand … Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioners : Mr. A. K. Kashyap, Sr. Advocate For the State : A.P.P. --- Order No. 02 Dated 30th March, 2026 Heard the learned counsel appearing for the respective parties. The petitioners are accused in connection with Hariharpur P.S. Case No. 63 of 2025. It has been alleged that the brother of the informant had gone to answer the call of nature, but he did not return. When despite a search he could not be traced out, a report was given to the police and when the police conducted a search in the house of Chhutu Thakur, the dead body of the brother of the informant was recovered. It has been submitted by the learned senior counsel for the petitioners that the petitioner No. 1 is aged about 70 years. Learned senior counsel submits that charge sheet has been submitted on completion of investigation and both the petitioners are in custody since 12.10.2025. It has further been submitted that the petitioners have been implicated primarily on account of the fact that they are family members of Chhutu Thakur. It has also been submitted that the main allegation is against Chhutu Thakur as apart from recovery of the dead body from his house, there was an earlier threat given to the deceased three months prior to the incident. Learned A.P.P. has opposed the prayer for bail of the petitioners. Regard being had to the fact that it was Chhutu Thakur who was instrumental in committing the murder of the brother of the informant and the petitioners having been implicated primarily on account of they being related to Chhutu Thakur, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Hariharpur P.S. Case No. 63 of 2025. (RONGON MUKHOPADHYAY,J.) 30.03.2026 MK Page-2
