IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.860 of 2026 Mahendra Nath Rout & others …. Petitioners Mr. J. Behera, Advocate -Versus- State of Odisha …. Opposite Party Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 09.02.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Bhadrak Rural P.S. Case No.428 of 2025 corresponding to G.R. Case No.1803 of 2025 pending in the court of learned S.D.J.M., Bhadrak on the grounds stated. 3. Perused the FIR as at Annexure-1. The entire details of the incident happened ever since marriage between the informant and accused husband have been narrated in Annexure-1, however, the Court finds that no any allegation of any dowry demand and related torture meted out to her appears to have been made therein. Admittedly, there is disturbance in marital life of the spouses. The informant was medically examined in view of the alleged mischief committed primarily directed against the accused husband. Learned counsel for the State produced the case diary, statements of the witnesses recorded under Section 180 BNSS and medical examination report of the informant. This report does not reveal any external injury received by the victim wife. From the statement of the victim recorded under investigation, it is further revealed that she was not properly treated by the petitioner, though, such allegation is directed against all. Considering the fact that the victim was not treated well after sometime when the marriage took place 11years before, this Court recording the objection of the State, though, not inclined to grant any of them pre-arrest bail, but is of the view that they should be directed to surrender before the learned court of learned S.D.J.M., Bhadrak for being released with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the learned S.D.J.M., Bhadrak in connection with Bhadrak Rural P.S. Case No.428 of 2025 corresponding to G.R. Case No.1803 of 2025 within a fortnight from today, they shall be released on bail upon furnishing bail bonds of Rs.25,000/-(rupees twenty five thousand) each with one solvent surety for the like amount each with other conditions imposed besides the following, such as, they shall not cause any harm to the victim and her family members, in any manner, whatsoever, while on bail. 6.
