By way of present application, the applicant/petitioner has prayed for waving off the condition of deposit 10% of cheque amount imposed vide judgment dated 10.04.2026. 2. It has been averred in the application that the applicant/petitioner is from a very poor financial background and has extremely limited means of livelihood. He has placed on record the income certificate, wherein his income has been shown as Rs.52,000/- per annum. 3. This Court, while allowing the revision petition preferred by the applicant/petitioner, had ordered him to deposit 10% of the cheque amount while setting aside the judgment of conviction and sentence passed by the learned trial Court, which was affirmed by the learned Appellate Court. The learned trial Court had ordered to pay a compensation of Rs.5,25,000/- to the complainant on account of dishonour of the cheque, issued by the petitioner. Since this Court had only ordered the petitioner to pay 10% of the cheque amount, keeping in view the condition of the applicant/petitioner, there is no reason to waive off the condition of deposit of 10% of the cheque amount, especially when the applicant/petitioner instead of paying the cheque amount before the learned trial Court had filed the appeal, which was dismissed and it is only before this Court, he had compromised the matter, that too, when he was taken into custody. However, this Court is inclined to extend the time to comply with the order to deposit 10% of the cheque amount by eight weeks from today. In case the applicant/petitioner does not deposit the amount within eight weeks from today, the consequences as per the judgment dated 10.04.2026, shall ensue. 4.
