JUSTICE VIJAYKUMAR A. PATIL) This contempt petition is filed alleging willful disobedience of the order dated 23.02.2021 passed by the learned Single Judge in W.P.No.11671/2020 (KLR-RES). The operative portion of the said order reads as under: "2. The grievance of the petitioner is pending consideration before the Tahasildar pursuant to AnnexureL dated 28.07.2020 insofar as undertaking phodi and durasth in Sy. No.332 at Sajjanakere Village, Chitradurga Taluk in the name of the petitioner in respect of the schedule property. The competent authority to undertake phodi and durasth - 3 - HC-KAR NC: 2026:KHC:8684-DB C.C.C. No.33/2023 proceedings is the jurisdictional Assistant Director of Land Records. Therefore, the petitioner is hereby directed to furnish copy of the application/representation in the prescribed format, if any, to the respondent No.3 – Assistant Director of Land Records, Chitradurga, Chitradurga Taluk to redress the grievance within a period of two months from the date of receipt of this order. 3. On receipt of such application/representation read with the revenue records and communications of the Office of the Tahasildar, if any, the same shall be taken into consideration for the purpose of redressing the petitioner’s grievance within a period of two months from the date of receipt of the petitioner’s application/representation.." 2. The accused No.1 - Assistant Director of Land Records, Molakalmuru Taluk, Chitradurga District, has filed an affidavit along with an endorsement dated 03.01.2023 issued to the complainant, wherein the request of the complainant for phodi and durashti was rejected for the reasons stated therein. - 4 - HC-KAR NC: 2026:KHC:8684-DB C.C.C. No.33/2023 3. In view of consideration of the representation as ordered by the learned Single Judge and issuance of an endorsement, the contempt proceedings are dropped.
