The petitioners are apprehending their arrest in connection with Mandu (Kujju) PS Case No.216 of 2025, for offence registered under section 103(1), 3(5) of BNS, 2023, pending in court of learned Additional Chief Judicial Magistrate, Ramgarh. 3. Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased. He submits that marriage of the deceased was solemnized with Govind Mahto and Govind Mahto and deceased were residing separately and these petitioners are residing separately. He next submits that Govind Mahto has faced the trial in S.T. No.11 of 2026 and he has been acquitted by the judgment dated 10.04.2026. He next submits that even the informant and other witnesses have turned hostile and due to that, Govind Mahto has been acquitted by the learned Sessions 2026:JHHC:12296 2 Judge. He next submits that initially the case was registered under section 103 BNS, 2023, however, subsequently, the charge sheet has been submitted against Govind Mahto under section 108 of BNS, 2023 and the charge sheet has not been submitted against the petitioners as yet. 4. Learned State counsel opposes prayer and submits that the allegations are there in the FIR of torturing upon all the accused persons including these petitioners. 5. Considering that the petitioners are father-in-law and mother-in-law, respectively, and it has been pointed out that they are residing separately and Govind Mahto who happened to be husband of the deceased has faced trial and has been acquitted as the witnesses have been declared hostile, and in that attending facts and circumstances of the present case, both the petitioners, above named, are, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release both the petitioners, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
