JUSTICE K.S. HEMALEKHA ORAL ORDER Memo is filed seeking permission to withdraw the petition which reads as under: "The Petitioner above named most humbly and respectfully submits as under: 1. That the Petitioner has filed the present Review Petition, being R.P.No.292/2023, seeking a review of the final order dated 17.03.2023 passed by this Hon'ble Court in W.P.No.13263/2020. 2. It is submitted that after filing the said Review Petition and upon further legal consultation, the Petitioner has been advised that the more appropriate and efficacious legal remedy to challenge the impugned order dated 17.03.2023 is by way of a Writ Appeal. 3. It is submitted that the grounds for challenge against the impugned order involve substantial questions of law and fact which can be more comprehensively and effectively adjudicated in a Writ Appeal, rather than within the limited scope of a review jurisdiction. 4. The Petitioner submits that the present withdrawal is bonafide and is sought to pursue the correct legal remedy as advised. The withdrawal is not intended to protract the litigation or to abuse the process of this Hon'ble Court in any manner whatsoever. 5. It is further submitted that no prejudice would be caused to the Respondents if the Petitioner is permitted to withdraw the present Review Petition with liberty to file a Writ Appeal, as the Respondents will have a full and fair opportunity to contest the said appeal on its merits. 6. The Petitioner states that reserving liberty to file a Writ Appeal is imperative to ensure that the - 4 - HC-KAR NC: 2026:KHC:17328 RP No. 292 of 2023 Petitioner is not left remediless and is able to agitate his grievances before the appropriate forum. The interest of justice would be met if such liberty is granted. In light of the aforesaid submissions, the Petitioner does not wish to press the present Review Petition and seeks permission of this Hon'ble Court to withdraw the same. WHEREFORE, the Petitioner most humbly prays that this Hon'ble Court may be pleased to Permit the Petitioner to withdraw the present Review Petition No.292/2023 and Reserve liberty unto the Petitioner to file a Writ Appeal challenging the order dated 17.03.2023 passed in W.P.No.13263/2020, in the interest of justice and equity." 2.
