The petitioner named above has been made accused in connection with Bengabad P.S. Case No. 225 of 2022 for the offence registered under Sections 147, 149, 341, 323, 307, 504, 506 and 353 of the Indian Penal Code, pending in the court of C.J.M., Giridih. As per the prosecution case, the petitioner has once escaped from the police custody and when the police went to arrest him, the petitioner and others assaulted the police party, including a lady constable, who were injured in the incident. It is submitted by learned counsel for the petitioner that other co- accused has been granted bail. Learned counsel for the State has opposed the prayer for bail and submitted that the petitioner has criminal antecedent and a flight risk and, therefore, his case does not stand on a similar footing. Considering the submissions advanced on behalf of the prosecution, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
