JUSTICE V SRISHANANDA ORAL ORDER The learned counsels for the parties have filed a Joint memo dated 24.06.2025, duly signed by them and the contents of the Joint Memo reads as under: "The Undersigned Counsels for Petitioner and Respondent most respectfully submits as follows; 1. The Petitioner has filed the present Cr.l Revision Petition filed u/s.397 R/W 401 C.R.P.C praying to set aside the judgment and order of conviction dated 26.02.2021 passed by the Court of Prl.Civil Judge and JMFC, Puttur D.K in C.C. No. 154/2016 and the judgment and order dated 07.11.2022 in CRL.A.NO.5018/2021 passed by the IV ADDL.DISTRICT AND SESSIONS JUDGE, Mangalore., D.K. 2. It is submitted that Petitioner and Respondent have amicably settled their disputes and arrived at a mutual understanding regarding the subject matter of the case. The Petitioner has deposited the Rs.1,30,000/- before Hon'ble trial court by virtue of the interim order of this Hon'ble court, the petitioner undertakes to pay remaining fine amount of fine Rs.1,30,000 within 23.07.2026. The respondent agreed to settle the matter for total amount of Rs.2,50,000/-. - 3 - HC-KAR NC: 2026:KHC:22469 CRL.RP No. 1526 of 2022 3. The respondent has agreed to settle the matter on payment of remaining amount of 1,25,000/- by Petitioner, towards full and final settlement of the fine amount. The Petitioner has objection to release the amount already deposited by petition before Hon'ble trial court. 4. Petitioner and Respondent will not have any other claims each other arising out of the present case. 5. Respondent has no objection to allow the present revision Petition on the grounds of amicable settlement". 2. Placing the Joint Memo on record, criminal revision petition stands disposed of. 3. The amount in deposit is ordered to be withdrawn by the complainant on due identification. 4. It is made clear that if the balance amount of compensation is not paid as agreed in the Joint Memo, revision petitioner shall undergo imprisonment as ordered by the Trial Magistrate, confirmed by the First Appellate Court.
