[2026:RJ-JP:28820] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 10881/2026 CNR: RJHC020654252026 | URN: CRLMB / 20135U / 2026 Manoj Kumar S/o Shri Ramprasad, Aged About 36 Years, R/o Ward No. 18, Holi Chowk, Palwas Road, Police Station Kotwali Sikar, District Sikar (Rajasthan) (At Present Accused Is Confined In District Jail, Sikar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Amit Singh Shekhawat For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 27/07/2026
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.100/2026 registered at Police Station Kotwali Sikar, District Sikar for offences under Section 108 of BNS, 2023.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is submitted that, though the allegation against the present petitioner is that he abetted the commission of suicide by the deceased, namely Vikas, there is no material on record to establish the essential ingredients of the alleged offence. It is further submitted that the prosecution case itself is that the deceased suspected the
[2026:RJ-JP:28820] (2 of 3) [CRLMB-10881/2026] petitioner of having an illicit relationship with his wife, Pooja. However, the record reveals that Pooja was residing at her parental home, and when the deceased went there to take her back, her parents refused to send her with him. Thereafter, the deceased allegedly committed suicide. It is further submitted that, even assuming for the sake of arguments that an illicit relationship existed between the petitioner and the wife of the deceased, the same, by itself, does not constitute an offence under the provisions of the Bharatiya Nyaya Sanhita, nor does it ipso facto amount to abetment of suicide in the absence of any material showing instigation, intentional aid, or active participation on the part of the petitioner. The petitioner has been in judicial custody since 23.04.2026 without any criminal past. Charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Manoj Kumar S/o Shri Ramprasad, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two
[2026:RJ-JP:28820] (3 of 3) [CRLMB-10881/2026] sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
