The petitioner named above has been made accused in connection with Sadar (Mahila) P.S. Case No. 15 of 2025 (S.T. No. 332 of 2025) for the offence registered under Sections 85, 89, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 and Section 3/4 of the Dowry Prohibition Act, 1961 pending in the court of Additional Sessions Judge-IV, Hazaribag. It is submitted by learned counsel for the petitioner that the petitioner happened to be the husband of the informant and it was a case of love marriage solemnized before the Special Marriage Officer, Hazaribagh on 18.11.2024. There is no medical evidence to support the allegation of causing miscarriage or any injury to the victim lady. The allegations are general and omnibus in nature. The petitioner is in custody since 07.06.2025. Learned counsel for the State, assisted by learned counsel for the informant, has opposed the prayer for bail and submitted that in order to cause miscarriage, medicine was administered to the victim by injecting it in the coconut water. As per the report submitted by the Medical Officer-Dr. Madhumita Kujur with the Investigating Officer, despite all cares and precautions, the lady suffered instant bleeding resulting in miscarriage. Under the circumstance of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
