MAHADEVA KANTHRIGALA The Court made the following: 4 VS,J W.P.No.17435 of 2019 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “…to issue a Writ, order or direction more fully one in the nature of Writ of Mandamus declaring the action of the Tahsildar/ 4th respondent in trying to take hectic steps to dispossess the petitioners from vacant land around their House Site admeasuring 521 Square Yards (435.5586 Square Meters), situated at Guddampalle Village, Pulikallu Gramapanchayat, Peddathippasamudram (P.T.M.) Mandal, Chittoor District ignoring boundaries in the register sale deed bearing No. 2670 of 1973 dated 20-07-1973 of Sub Registrar, Madanapalli as biased, illegal and void and consequently direct the respondents not to take any coercive steps for dispossession of the petitioners from the aforesaid land as long as above sale deed is in force to secure the ends of justice…” 2. The petitioners claim to be the absolute owners and possessors of the land admeasuring Acs.521 square yards situated in Guddampalle village, Peddathippasamudram mandal, Chittoor district and that the same was purchased by his father under a registered sale deed bearing document No.2670 of 1973, dated 20.07.1973 on the file of Sub- Registrar, Madanapalli. Ever since, the petitioners and their father have been in possession of the same. 3. While the matter stood thus, the 5th respondent started interfering with the petitioners’ possession over the subject property alleging that the 4th respondent granted house site patta for the land 5 VS,J W.P.No.17435 of 2019 admeasuring Acs.1½ cents, adjacent to the petitioners’ land, as the same is gramakantam land. Subsequently, the 4th respondent visited the subject property and orally proclaimed that the petitioners’ land is also a gramakantam land and that they have to vacate the same in order to grant house sites to beneficiaries. Aggrieved by the same, the present writ petition is filed. 4. When the writ petition came up for admission on 06.11.2019, this Court passed the following interim order: “Having regard to the facts and submissions, there shall be a direction to maintain status quo in regard to the possession of the petitioners over the subject property till the next date of hearing.” 5. The 4th respondent filed a detailed counter affidavit duly admitting the possession of the petitioners over the subject land and further contended that the respondents have never tried to resume the subject land for the alleged purpose of granting house site pattas and the respondents have no interest to do so, since another alternative land is identified and proposed for allocation of house site pattas. It is further stated that house site pattas have already been issued and that if the petitioners’ land is required for resumption in future, the respondent authorities would strictly adhere to the due process of law, by giving ample opportunity of hearing to the petitioners. As such, requested to dismiss the writ petition. 6 VS,J W.P.No.17435 of 2019 6. Heard Sri. D. Srinivasa Rao, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. 7. Perused the entire material available on record. It can be seen from the record that pursuant to the interim orders passed by this Court, the respondent authorities have not interfered with the possession of the petitioners over the subject land. Furthermore, the respondents have admitted that at present, there is no necessity to resume the subject land for utilizing the same for public purpose and that they would follow due process of law, if the petitioners’ land is required in the future. 8. In view of the same, this writ petition is disposed of directing the respondent authorities not to interfere with the petitioners’ possession over the land admeasuring Acs.521 square yards situated in Guddampalle village, Peddathippasamudram mandal, Chittoor district, without following due process of law.
