APHC010004482026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3458] TUESDAY, THE 15th DAY OF SEPTEMBER 2026 PRESENT THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 1146 OF 2026 Between: 1. THE VISAKHAPATNAM METROPOLITAN REGIONAL DEVELOPMENT AUTHORITY VMRDA, REP BY ITS COMMISSIONER, VISAKHAPATNAM, VISAKHAPATNAM DISTRICT - 530001 3. THE VICE CHAIRMAN VMRDA, VUDA COMPLEX, SIRI PURAM, VISAKHAPATNAM, VISAKHAPATNAM DISTRICT - 530001. ...RESPONDENT(S): Counsel for the Petitioner: 1. T N M RANGA RAO Counsel for the Respondent(S): 1. SOMISETTY GANESH BABU SC For VUDA 2. SREEKANTH REDDY AMBATI 3. GP MUNCIPAL ADMN AND URBAN DEV AP 2 The Court made the following order: Heard Sri T.N.M.Ranga Rao, learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and learned Standing Counsel for VMRDA appearing for respondent Nos.2 and 3. 2. The grievance of the petitioner in the instant Writ Petition is against the action of the respondents in proposing to put the property in a public auction without considering the representation of the petitioner dated 24.12.2025, and in disregard of the directions of this Court dated 25.01.2019 in W.P.No.483 of 2019. 3. Learned counsel for the petitioner contends that the petitioner purchased house plot(s) measuring 400 square yards, i.e., 320 square yards in Sy.No.277/1c and 80 square yards in Sy.No.278, situated in Madhurawada Village, within the limits of the Greater Visakhapatnam Municipal Corporation. Adjoining the petitioner's land, there is a piece of land belonging to VUDA measuring more than 200 square yards; the petitioner has applied for allotment of the same. After receiving the Earnest Money Deposit (EMD) of Rs.50,000/-, the respondents proposed to conduct a public auction. Challenging the same, the petitioner filed W.P.No.483 of 2019. The said Writ Petition was disposed of, directing the respondents to consider and dispose of the petitioner's representation dated 04.01.2019 before the public auctions scheduled for 29.01.2019 and 31.01.2019. The petitioner was also granted liberty to participate in the public auctions. It is contended that the public 3 auctions were neither conducted on 29.01.2019 and 30.01.2019 as was proposed, nor was the petitioner's representation considered. Hence, the present writ petition. 4. Respondent Nos.2 and 3 filed a counter-affidavit stating that, before the disposal of the earlier W.P.No.483 of 2019, VMRDA addressed a letter to the petitioner to apply online on or before 24.01.2019 to participate in the public auctions scheduled on 29.01.2019 and 30.01.2019. As per the policy of VMRDA, any odd bit of land exceeding 100 square yards can be disposed of only through a public e-auction in accordance with the Standard Operating Procedure (SOP) of VMRDA. Allotment unilaterally in favor of the petitioner is not provided under law, any disposal of the property must be in accordance with the provisions of VMRDA Act, guidelines and policies framed in the said regard. 5. The public auction scheduled on January 2019 was not conducted due to administrative reasons, and the amount was also refunded. Thus, VMRDA contends that the petitioner cannot seek the allotment of land as a matter of right. 6. The petitioner filed a reply affidavit stating that VMRDA made a discriminative attempt by allotting an extent of 100 square yards of land in favor of one M/s. Lucky Housing Projects. 7. Considered the submissions. 4 8. The petitioner is seeking a direction to the respondents to consider their request in terms of the order passed by this Court dated 25.01.2019 in W.P.No.483 of 2019. In light of the same, reliance is placed on the proceedings of the VMRDA dated 26-06-2025, allotting land in favour of M/s. Lucky Housing Projects., and prays for considering his case in accordance with the said proceedings and also having regard to the G.O. 9. A perusal of the said proceedings would reflect that the allotment property was made in the case of M/s. Lucky Housing Projects pursuant to the e-auction conducted by VMRDA. 10. Having regard to the same, the relief sought by the petitioner to issue a mandamus for unilateral allotment of land in their favour is not maintainable as the said claim is not supported by any statutory provisions. However, the petitioner is at liberty to participate in the public auction whenever the respondent authorities propose for it. 11. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Dated: 15.09.2026 BSK 5 75 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 1146 OF 2026 Dated: 15.09.2026 BSK
