The Petitioner has approached this Court for grant of regular bail in connection with Chakradharpur Rail P.S. Case No. 02 of 2025, corresponding to S.T. No. 306 of 2025, registered for the offence under Section 305(C) of Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner is not named in the F.I.R and his name has transpired only on the basis of confessional statement of co-accused and no incriminating article has been recovered from his possession. He further submits that the petitioner is in custody since 29.11.2025; as such, he may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court. 4. Learned A.P.P opposes the prayer for bail of the Petitioner. 5. Having regard to the aforesaid facts of the case and looking to the allegation made against this petitioner, coupled with the fact that name of the petitioner has transpired on the basis of confessional statement of co- accused and also the fact that the petitioner is in custody since 29.11.2025; I am inclined to enlarge the Petitioner 2026:JHHC:6777 2 on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Chaibasa in connection with Chakradharpur Rail P.S. Case No. 02 of 2025, corresponding to S.T. No. 306 of 2025. 6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
