JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: i. issue writ of certiorari quash the order passed by the Learned X Additional Chief Metropolitan Magistrate, Bengaluru City, in dated No.50426/2021 04.01.2022, C.Misc. vide Annexure-F, ii. issue writ of certiorari or any other appropriate writ or direction, quash the proceedings initiated by the respondent Bank under Section 13 of the Securitization Act 2002, iii. Pass any other writ or direction which may be deem fit to grant under the facts and circumstances of the above in the interest of justice and equity. The petitioner has not made out any legal grounds to entertain this writ petition and in the light of the settled law, when there is an efficacious alternative remedy, the writ court exercising jurisdiction under 226 of constitution of India, will not entertain the writ petition. - 3 - HC-KAR NC: 2026:KHC:17882 WP No. 666 of 2022 Accordingly, this court is passing the following: ORDER i. The writ petition is disposed of giving liberty to the petitioner to avail the appropriate remedy before the DRT. ii. Petitioner shall have the benefit under Section 14 of the Limitation Act. iii. Petitioner shall have the benefit of interim order for a period of four weeks from the date of receipt of the copy of this order. iv. All pending I.As., in the writ petition shall stand closed.
