This criminal miscellaneous petition has been filed under section 528 of the B.N.S.S., 2023 by the petitioner with the prayer for modification of the order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025. It is submitted by the learned counsel for the petitioner that vide order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025 the petitioner was directed to appear before the trial court on the next date fixed vide order dated 23.09.2025 but as the petitioner became ill, hence he could not appear before the learned trial court on the next date fixed i.e. 16.10.2025. Hence, it is submitted that time to appear before the court below in terms of the order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025 be extended for six weeks from the date of this order. Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to appear before the court below in terms of the order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025 is allowed. Hence, the petitioner is directed to appear before the court below in terms of the order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025 within six weeks from the date of this order”. The order dated 23.09.2025, passed in Cr.M.P. No. 2750 of 2025 is modified to the aforesaid extent only.
