JUSTICE RAHUL BHARTI, JUDGE JUDGMENT (ORAL) - 1. This petition is disposed of at very inception stage premised on the point that the Hon’ble Supreme Court of India, in the case of “Director (Admn and HR) KPTCL & Ors Vs. C.P. Mundinamani & Ors., 2023 AIR (SC) 1956” has settled the position of law with respect to grant and sanction of annual increment in the context of a public servant attaining superannuation. 2. The petitioner has come forth with a plea that by virtue of an Office Memorandum dated 20.05.2025, the Government of India, through its Ministry of Personnel, Public Grievance & Pensions, Department of Personnel & Training, has issued Office Memorandum No. 19/116/2024-Pers. Pol. Serial No. 140 Regular List WP(C) No. 1349/2026 (Pay) (Pt) dated 20.05.2025 and clause 3(d) of said Office Memorandum squarely covers the case of the petitioner who is an ex-CRPF personnel having retired as Sub Inspector (MT) with effect from 30.06.2012 from 189 Bn. CRPF. 3. Mr. Vishal Sharma, DSGI submits that if the petitioner is drawing parity of his case with the law as settled by the Hon’ble Supreme Court of India, surely the respondent Nos. 2 to 5 would not hesitate in according examination and consideration to the case of the petitioner and come up with a consideration order passed on merits. 4. This writ petition is thus disposed of with a direction to the respondent Nos. 2, 4 & 5, whosoever amongst them is competent to deal with the issue related to grant of increment in favour of the petitioner, to consider the present writ petition of the petitioner as representation and come up with consideration order by or before 30.06.2026. 5. Copy of this petition along with annexures be provided to Mr. Vishal Sharma, learned DSGI. 6. The disposal is without prejudice the position of both sides. In case, consideration order comes out to be adverse against the petitioner, then the petitioner would have the right of coming up with a fresh ptition.
