The petitioner is seeking regular bail, in connection with Markacho P.S Case No. 70/2025, for the offences U/S 303(2), 317(2) of B.N.S., pending in the court of learned J.M.F.C., Koderma. 3. Learned counsel appearing for the petitioner submits that false allegations are made against the petitioner and in the cold storage, one Luna and motor of generator have been recovered. He further submits that it is stated that with the help of the villagers, the petitioner was caught by the police. However, in the seizure list, there is no independent witness and only the police officials have signed the said seizure list. He next submits that the petitioner is in custody since 2.9.2025. 4. Learned counsel appearing for the state opposed the prayer and submits that the petitioner was fleeing away from the place. 5. Considering that in the FIR, it has been stated that with the help of the villagers, the petitioner was caught, however, in the seizure list, there is no independent witness and the petitioner is in custody 2026:JHHC:1129 2 since 2.9.2025, I am inclined to grant regular bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Koderma in connection with Markacho P.S Case No. 70/2025.
