KADAPA DISTRICT.516293 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.3 and 4 in interfering with our rights over the land in an extent of Ac. 3.55 cents in Sy.No. 10-2 of Thollagangapalle Village, Valluru Mandal, Y.S.R Kadapa District, without adhering to due process of law and without putting us on notice as arbitrary, illegal, colorable exercise of power and contrary to the well established legal principles apart from being violative of the fundamental and the Constitutional rights guaranteed to us under Articles, 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere with our rights over the land in an extent of Ac. 3.55 cents in Sy.No.10-2 of Thollagangapalle Village, Valluru Mandal, Y.S.R Kadapa District and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to interfere with our rights over the land in an extent of Ac. 3.55 cents in Sy.No. 10-2 of Thollagangapalle Village, Valluru Mandal, Y.S.R Kadapa District, without adhering to due process of law, pending disposal of the above Writ Petition and pass Counsel for the Petitioner(S): 1. V R REDDY KOVVURI Counsel for the Respondent(S): 1. GP FOR REVENUE The Court made the following: ORDER Heard Sri Vigneswar Reddy, learned counsel representing Sri V.R. Reddy Kovvuri, learned counsel for the petitioners and Sri Chandra Sekhar, learned Assistant Government Pleader for Revenue, for the respondents. 2. The grievance of the petitioner is that the respondents 3 and 4 are interfering with the petitioners’ possession and enjoyment of an extent of Ac.4.55 cents in S.No.10-2 of Thollagangapalle village, Valluru Mandal, YSR Kadapa District, without issuing any notice and without following due process of law. 3. Learned counsel for the petitioners would submit that the petitioners purchased the aforementioned land under two registered sale deeds dated 14.06.2013 (Ex.P1) and 29.08.2018 (Ex.P2). The 4th respondent updated the name of the petitioners in the Records of Rights and issued a pattadar pass book (Ex.P3). Other revenue records were also filed. He would submit that without issuing any notice, the 4th respondent is attempting to dispossess the petitioners from the said land. 4. Sri Chandra Sekhar, learned Assistant Government Pleader for Revenue for the respondents, on instructions, would submit that per RSR, an extent of Ac.6.55 cents of land in S.No.10 is classified as Dotted land. He would submit that if any action is needed for public purpose or any other necessity, the authority shall issue notices and follow due process of law. 5. Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter will not serve any purpose. 6. Accordingly, the Writ Petition is disposed of at the admission stage with the consent of learned counsel on either side, directing the respondents 3 and 4 not to interfere with an extent of Ac.4.55 cents in S.No.10-2 of Thollagangapalle village, Valluru Mandal, YSR Kadapa District, without following due process of law.
