Shaik Saddam, S o late Shaik Fatima Bee and Shaik Mahboob Basha aged Major Occ Business R o D No 9 7 139 and 140 Kacheri Street Sullurpet Tirupati District 524121 ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ order or direction more particularly in the nature of MANDAMUS Declaring the action of Respondents 2 to 4 in not providing new Electricity Connection in the name of Dargah namely Ashurkhana known as Hazarath Khader Vali Dargah Jhanda Ground and Peerla Chavidi situated at Sullurpet Town by removing the old meter or to mutate the name of the Dargah on the existing Service Connection numbers 3631303022417 and 3631303002986 on the premises Nos 9 7 139 old No 10 3 156 and 9 7 140 old No 10 152 49 situated at Kacheri Street in Sy No 18 1 A Sullurpet Town and Mandal Tirupati District having received representations dated 30 3 2022 and 27 7 2026 as being Illegal Arbitrary Capricious Malafide not only contrary to the order in W P No 2732 of 2022 but also contrary to the various provision of Electricity Act IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the respondents 2 to 4 either to provide new meter by removing old meter or to mutate the name of the Dargah in respect of the service connection Nos 3631303022417 and 3631303002986 on the premises Nos 9-7-139 ( old No 10-156), and 9-7-140 ( old No 10-152/49 situated at Kacheri Street, Sullurpet Town and Mandal, Timpati District deem think fit and proper in the circumstances of the case Counsel for the Petitioners: M MEHDI HUSSAIN Counsel for the Respondents: GP FOR ENERGY The Court made the following order: 4 THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 26046 OF 2026 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue an appropriate writ, order or direction more particularly in the nature of MANDAMUS declaring the action of Respondent Nos.2 to 4 in not providing new Electricity Connection in the name of Dargah namely Ashurkhana known as Hazarath Khader Vali Dargah, Jhanda Ground and Peerla Chavidi situated at Sullurpet Town by removing the old meter or to mutate the name of the Dargah on the existing Service Connection numbers 3631303022417 and 3631303002986 on the premises Nos 9-7-139 (old No.10-156) and 9-7-140 (old No.10-152/49) situated at Kacheri Street in Sy.No.18-1A Sullurpet Town and Mandal, Tirupati District having received representations dated 30.3.2022 and 27.7.2026 as being Illegal, Arbitrary, Capricious, Malafide not only contrary to the order in W.P.No.2732 of 2022 but also contrary to the various provision of Electricity Act and pass such other order or orders….” 2. Heard learned counsel for the petitioners and Sri K.Venkata Rama Rao, learned Standing Counsel for the respondents. 3. Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, without touching the merits of the case, to issue a direction to the respondents to consider and dispose of the representations dated 30.03.2022 and 27.07.2026 submitted by the petitioners. 5 4. On the other hand, learned Standing Counsel appearing for the respondents readily agreed to dispose of the representations dated 30.03.2022 and 27.07.2026 submitted by the petitioners, pending with the authorities, within a reasonable time. 5. In view of the submission of the learned Government Pleader for the respondents, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioners himself requested to issue a direction to dispose of the representations dated 30.03.2022 and 27.07.2026 submitted by the petitioners, this Court find no other alternative except to issue such direction. 6. In the result, with the consent of both the learned counsel, the Writ Petition is disposed of, directing the respondents to consider and dispose of the representations dated 30.03.2022 and 27.07.2026 submitted by the petitioners, if necessary, after providing opportunity of hearing to all the parties concerned, within a period of four (04) weeks from the date of receipt of a copy of this order.
