JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in Crime No.168/2025 for the offences punishable under Sections 406 and 420 of the IPC. 2. Heard Sri. Rohan Kothari, learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned - 3 - HC-KAR NC: 2026:KHC:21780 WP No. 15273 of 2025 Addl. SPP appearing for respondent No.1, Sri. C.S. Prasanna Kumar, learned counsel appearing for respondent No.2, Sri. Francis Xavier, learned counsel appearing for respondent No.3 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard. The Joint Memo so filed reads as follows: “JOINT MEMO BY THE PETITIONER AND RESPONDENT NO.2 The Petitioner and Respondent No.2 jointly submit as follows: 1. The captioned petition was filed seeking quashment of the Complaint dated 25.04.2025 filed by Respondent No. 2 (Annexure-B) as representative of M/s. Chaitra Civil Ventures LLP, and FIR dated 25.04.2025 bearing Cr. No. 168/2025 registered by Respondent No. 1 against the Petitioner for alleged commission of offences punishable under Section 406 and 420 IPC (Annexure-A), as well as Respondent No. 1's notice dated 12.05.2025 vide which the Petitioner's bank account came to be frozen (Annexure-C). 2. It is submitted that by order dated 02.06.2025, this Hon'ble Court was pleased to direct Respondent No.3 Bank to de-freeze the Petitioner's bank account. Thereafter, on 20.06.2025, this Hon'ble Court was pleased to stay all further proceedings in the Impugned FIR. The interim orders dated 02.06.2025 and 20.06.2025 remain in force as on date. 3. Apart from the impugned FIR, the Petitioner and Respondent No.2 were involved in other civil and criminal disputes inter se, as well as between their respective - 4 - HC-KAR NC: 2026:KHC:21780 WP No. 15273 of 2025 affiliated entities. In the Interregnum, the Petitioner and Respondent No.2 have agreed to amicably resolve all disputes, both civil and criminal, between them and their affiliated entities by way of a Settlement Agreement dated 21.11.2025 and a Letter Agreement (Addendum) dated 05.12.2025. (Copies of the Settlement Agreement dated 21.11.2025 and Letter Agreement dated 05.12.2025 are annexed hereto as Document No.1 and Document No. 2) 4. In view of the above, the Petitioner and Respondent No.2 jointly submit that all disputes between them have been amicably settled, pursuant to which Respondent No.2 has consented to the allowing of the present petition and has no objection whatsoever to the quashing of the impugned FIR and Complaint and the impugned notice. WHEREFORE, it is respectfully prayed that the present joint memo is taken on record and the impugned Complaint dated 25.04.2025 (ANNEXURE-B) along with the impugned FIR dated 25.04.2025 bearing Cr. No. 0168/2025 registered by Respondent No.1, for offences punishable under Section 406 and Section 420 of the IPC, 1860, (ANNEXURE-A), be quashed, and consequently, the impugned notice dated 12.05.2025 (ANNEXURE-C) issued by Respondent No. 1 be quashed, in the interest of justice.” 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of the Joint Memo being filed and offences not being against the State, I deem it appropriate to accept the said Joint Memo and terminate the proceedings against the petitioner in the subject petition. - 5 - HC-KAR NC: 2026:KHC:21780 WP No. 15273 of 2025 6. For the aforesaid reasons, the following: ORDER i. Writ Petition is disposed. ii. Proceedings in Crime No.168/2025 registered by the Doddaballapura Rural Police Station, Bengaluru Rural, stands quashed qua the petitioner. iii. The impugned notice dated 12.05.2025 issued by Doddaballapura Rural Police Station, Bengaluru Rural, stands quashed and set aside qua the petitioner.
