1. This misc. bail application has been filed by the petitioner Bhavuti S/o Late Shri Inder, who was arrested by the police in connection with the FIR bearing No.102/2025 dated 01.10.2025 registered at Police Station Mamchari District Karauli for the offences punishable under Sections 115(2), 126(2), 332(c) and 110 B.N.S.

Learned counsel submitted that the bail application filed by the petitioner was rejected by the Additional Session Judge, Karauli vide order dated 06.02.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S.

Learned counsel for the accused-petitioner submitted that the complainant has levelled allegations against the petitioner by concocting false facts and exaggerating some incident in the FIR.
Learned counsel submitted that the accused-petitioner and complainant are neighbors and there are no criminal antecedents

Learned counsel further submitted that no such incident had occurred, and the injuries as pointed out during the investigating are not grievous and further there is no bone injury to the child. Learned counsel further submitted that the police after investigation filed the charge-sheet, no recovery is required to be made. Learned counsel further submitted that the accused-petitioner is the sole accused and is behind the bars since long and the trial will take sufficiently long time. In view thereof,
learned counsel prayed that the accused-petitioner be enlarged on bail.
4. Learned Public Prosecutor strongly opposed the bail application.

This Court, after considering the content of the FIR, charge- sheet has already been filed, trial will take sufficiently long time, the nature of injuries as suffered by the child, as well as the fact that the petitioner is behind the bar since 11.10.2025, and further noted that the petitioner and the complainant are the neighbors, and have no previous enmity and no case is pending between them. It appears that on account of some sudden incident, alleged incident took place in which child suffered some injuries which are not serious in nature. Looking to the overall facts and circumstances of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Bhavuti S/o Late Shri Inder on bail.
6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Bhavuti S/o Late Shri Inder shall be released on bail, provided
[2026:RJ-JP:11539] (3 of 3) [CRLMB-4258/2026] he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
7. It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
