ORDER : YARENJUNGLA LONGKUMER, J. 1.Heard Mr. Anjan. S, learned counsel for the petitioner. Also heard Mr. T. Ete, learned Additional Public Prosecutor for the State respondent. 2. This is an application under Section 483 of the BNSS, praying for grant of bail to the alleged accused person, namely, Shri Kekuolhulie Suokhrie. 3. At the outset the learned Additional Public Prosecutor has objected to the fact that the applicant herself is an accused in the Itanagar Women P.S. Case No. 53/2025, and therefore, she cannot be the applicant in the present case. It is also stated that the applicant was released on bail by the Sessions Court by order dated 27.10.2025 and therefore, she is still in the constructive custody of the Sessions Court and in the event of cancellation of her bail for any reason, the applicant would be an under trial and therefore, this present petition would not be maintainable. 4. This Court has considered the submissions and it is of the view that in the order dated 27.10.2025, the Sessions Court had made an observation that the applicant herein was never arrested during the investigation. 5. The learned counsel for the petitioner has made further submission that the applicant and the accused is not the local of the State and therefore, there are difficulties in finding an applicant to represent him. This Court finds that there would be no legal bar for the applicant to represent the accused person in the present application. Issue notice to the respondents. 6. The petitioner shall take steps for service of notice on respondent No. 2 through the office of the Public Prosecutor to be routed through the Registry of this Court. 7. The Registry shall call for the scanned copy of the case records from the Court of learned Special Judge (POCSO), Yupia. 8. List the matter after 2(two) weeks.
