ORDER:
Learned counsel for the petitioner and learned counsel for the respondent No.2 submit that the petitioner/Accused is no more.
2. During the pendency of the appeal, 20% of the cheque amount was deposited before the learned Magistrate pursuant to the directions given by the learned Appellate Court.
3. Respondent No.2 is at liberty to withdraw the same without producing any sufficient surety before the learned Magistrate within a period of one week from the date of receipt of a copy of this order. The learned Magistrate is directed to do the needful.
4. In view of the above, the Criminal Revision Case is dismissed as abated. There shall be no order as to costs.
