This first bail application has been moved by the applicant seeking regular bail in F.I.R./Case Crime No.364 of 2023, under Sections 2(b)(i), 2(b)(xi) and 3 of Uttar Pradesh Gangster Act and Anti- Social Activities (Prevention) Act, 1986, registered at Police Station Bhadarabad, District Haridwar. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has been languishing in judicial custody for a considerable period. It is contended that, as per the F.I.R., a Gang Chart showing pendency of 18 criminal cases against the applicant has been prepared; however, the applicant has already been granted bail in all the said 18 cases mentioned therein. Learned counsel further submits that the applicant is the sole breadwinner of his family and, due to his prolonged incarceration, the entire family is on the verge of starvation. It is further submitted that in the event the applicant is released on bail, he shall not misuse the liberty so granted and shall furnish adequate bail bonds and sureties to the satisfaction of this Court. 4. Learned State Counsel has vehemently opposed the prayer for bail. 2026:UHC:620 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Kuldeep Nandrajog be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
