Agarwala, learned counsel appearing for the claimants/respondent Nos.1—3. This is an application Section 5 of the Limitation Act, 1963, praying for condonation of delay of 28 days, in filing the connected appeal against the Page No.# 3/3 judgment and award dated 03.04.2025, passed by the learned Member, MACT No.2, Kamrup (M) at Guwahati, in MAC Case No.2157/2022. It is submitted by Ms. Borthakur, the learned counsel for the applicant/appellant that the delay is occurred only for observing some official formalities and obtaining the certified copy of the judgment etc. and there are no intentional lashes or negligence on the part of the appellant in preferring the connected appeal. She further submitted that the delay is already explained in para 2 of the present interlocutory application. Mr. Agarwala, the learned counsel for the claimants/ respondent Nos.1—3 has raised no objection and submitted that he has no objection if the delay of 28 days in filing the connected appeal is condoned in preferring the present appeal. Considering the submissions made by learned counsel for the parties and the grounds mentioned, which are considered to be reasonable and justified, the delay of 28 days in filing the present appeal is hereby condoned. The Registry is accordingly directed to register the appeal and list the same accordingly after three (3) weeks, by reflecting the name of learned counsel for the respondent Nos.1—3 in the cause list and in the case record.
