GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- <…to issue a Writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents more specifically respondent Nos.5 to 7, in summoning the petitioners to the police station and harassing them without following due process of law and without there being any crime registered against them, under the guise of enquiry, as illegal, arbitrary, without jurisdiction, and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the respondents not to summon the petitioners to police station except in accordance with due process of law ….= 2. Heard the learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Sri T. Diwakar Reddy, learned counsel for the Petitioners, submits that the Petitioners have been unnecessarily summoned to the Police Station without following due process of law, and were subjected to unwarranted restraint and harassment. 3 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the brother of Petitioner No.1 had eloped with a married woman, in connection with which a case in Cr.No.25 of 2026 was registered by the Station House Officer, M.V.P. Police Station, and investigation was conducted. In the course of investigation, it was revealed that the lady who had allegedly eloped with the brother of Petitioner No.1 gave a statement that she had gone with him of her own accord. Therefore, the police were constrained to refer the case as <Action Dropped.= 5. Considering the above submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Respondent Police not to call henceforth the Petitioners to the police station without any basis and except in accordance with law. The Petitioners are directed to cooperate with the Investigating Officer in the investigation. The Investigating Officer may proceed with the investigation in accordance with law. If it is noticed that the Petitioners have indulged in the commission of any offence, the Investigating Officer is at liberty to proceed against them in accordance with law. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
