1. Heard Sri Durgesh Kumar Singh, learned Senior Counsel assisted by Sri R.P. Rajan, learned counsel for the applicant and Sri Ashutosh Singh, learned AGA for the State. 2. The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 99 of 2026, under Section 4, 5 Immoral Traffic (Prevention) Act, 1956, Police Station Lanka, District Varanasi, during pendency of the trial. 3. Learned counsel for the applicant submits that, however, as per allegation, applicant indulged in illegal sex trade along with other accused and he was one of the touts but entire allegations made against him are totally false. 4. He next submits, admittedly the alleged guest house from where girls were recovered did not belong to the applicant and co-accused Anil Kumar Pandey was owner of the guest house and co-accused Jitendra Kumar was Manager of the guest house and both have been released on bail by the coordinate Bench of this Court. 5. He next submits, Anil Kumar Pandey has been released on bail by the coordinate Bench of this Court, vide order dated 31.03.2026 passed in Criminal Misc. Bail Application No.10823 of 2026 and co-accused Jitendra Kumar has been released on bail by the coordinate Bench of this Court, vide order dated 13.04.2026 passed in Criminal Misc. 6. He next submits, the case of the applicant is even on better footing than both the above accused. 7. He further submits, applicant is not having any criminal history and he is in jail in the present matter since 20.02.2026 i.e., for the last more than two months. 8. Per contra, learned AGA opposed the prayer for bail but could not dispute the arguments on facts advanced by learned counsel for the applicant. 9. I have heard learned counsel for the parties and perused the record of the case. 10.
However, as per allegations, applicant one of the touts and he along with other co-accused persons involved in illegal sex trade but as per prosecution, alleged girls were recovered from the guest house, which belonged to co-accused Anil Kumar Pandey and co-accused Jitendra Kumar was Manager of the guest house and both the above co-accused have been released on bail by the coordinate Bench of this Court. 11. Further, applicant is not having any previous criminal history to his credit and in the present matter, he is in jail since 20.02.2026 i.e. for last more than two months. 12. Therefore, considering the facts and circumstances of the case discussed above, in my view, applicant is entitled to be released on bail. 13. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 14. Let the applicant- Mohammad Zafar @ Raju @ Guddu Khan be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted. (ii) The applicant shall not directly or indirectly, make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer BAIL No. 9171 of 2026 2
or tamper with the evidence. (iii) The applicant shall not indulge in any criminal and anti-social activity. 15. In case of breach of any of the above condition, the prosecution will be at liberty to move an application before this Court for cancellation of the bail of the applicant. 16.
It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
