Mr. Satyendra Agarwal Mr. Tarak Nath Sarkar Mr. Goutam Malick ….for the de facto complainant. Heard the learned counsels for the petitioners, the de facto complainant and the State. Perused the case diary. The prosecution case is that the petitioners were two carpenters who had come to work in the house of the de facto complainant and, taking advantage of the absence of others, they allegedly sexually assaulted the 12 year old survivor. Considering the serious nature of allegations, the incriminating materials available in the case diary including the statements of the alleged survivor and the medical report, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
