THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. This petition under Section 528 of BNSS, 2023, is filed with a prayer to quash the entire proceedings in Crime No.52/2026 registered by Thalaghattapura Police Station, Bengaluru City, for the offences punishable under Sections 115(2), 118(1), 352, 351(2), 190 of BNS, 2023. 2. Learned Counsel for the parties jointly submit that the dispute between the parties has been amicably settled and a memo reporting settlement is filed before this Court. 3. FIR in the present case has been registered against the petitioner herein and others for the offences punishable under Sections 115(2), 118(1), 352, 351(2), 190 of BNS, 2023. All the alleged offences against the petitioner are compoundable in nature. Parties have filed a memo reporting settlement and it is stated in the memo that at the intervention of elders, well- - 3 - HC-KAR NC: 2026:KHC:12113 CRL.P No. 3033 of 2026 wishers and family members of both the parties, the matter has been settled, and it is also stated that the settlement arrived between the parties is voluntary, without there being any undue influence or and. 4. The parties who are present before the Court, are identified by their respective learned advocates. In paragraph nos.2 to 6 of the memo for settlement which is signed by the parties, it is stated as under: "2. The dispute between the petitioner and respondent no.2 arose out of a personal misunderstanding and trivial quarrel between acquaintances. 3. With the intervention of elders, well-wishers and family members, the parties have amicably resolved their differences. 4. The settlement has been arrived at voluntarily, without any force, coercion, undue influence or threat from any quarter. 5. Respondent no.2 has no subsisting grievance against the petitioner and has no objection for quashing of the FIR and all consequential proceedings in Crime No.0052/2006. - 4 - HC-KAR NC: 2026:KHC:12113 CRL.P No. 3033 of 2026 6. The parties submit that the dispute is purely personal in nature and continuation of criminal proceedings would serve no useful purpose and would amount to abuse of process of law." 5. Under the circumstances, I am of the opinion that this Court in exercise of its powers under Section 528 of BNSS, 2023, has no impediment to quash the entire proceedings impugned in this petition as against the petitioner herein to secure the ends of justice. Accordingly, the following order: 6. Petition is allowed. The entire proceedings in Crime No.52/2026 registered by Thalaghattapura Police Station, Bengaluru City, for the offences punishable under Sections 115(2), 118(1), 352, 351(2), 190 of BNS, 2023, as against the petitioner herein, is quashed.
