Kakinada-(East-Godawari)-District - 533001 ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the Respondents to register the FIR on petitioner complaint dated 9.11.2024 is highly illegal arbitrary violation of 2 Articles 14 ,21 of the Constitution of India and also violation of the principles of natural justice and consequently direct the Respondents to register the FIR on petitioner complaint dated 9.11.2024 IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents No.2 to 4 to register the FIR on petitioner complaint dated 9.11.2024 Counsel for the Petitioner: TOTA TEJESWARA RAO Counsel for the Respondents: GP FOR HOME 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 12609 of 2026 The Court made the following Order: Instant Writ Petition has been filed on behalf of petitioner under Article 226 of the Constitution of India for the following relief: “to issue a writ order or Direction more particularly one in the nature of Writ of Mandamus to declare the inaction of the Respondents to register the FIR on petitioner complaint dated 9.11.2024 is highly illegal, arbitrary, violation of Articles 14, 21 of the Constitution of India and also violation of the principles of natural justice and consequently direct the Respondents to register the FIR on petitioner complaint dated 9.11.2024 and pass” 2. Today when the matter is taken up for hearing, learned Assistant Government Pleader for Home, on written instructions, submits that the police, after due investigation, referred the case as “Undetectable” vide C.No.970/RCO/SDPO-P/2025, dated 28.11.2025 of Sub-Inspector of Police, Thondangi Police Station, Kakinada District, which reads as under: “Since the date of report and till today, myself and my staff made all the efforts to trace out the probable offenders by visiting so many villages, town besides corner places but got no fruitful clues. There is no chance to detect the case in near future. 4 Accordingly, the case was referred as Un-detectable on 28.11.2025 vide C.No.970/RCO/SDPO-P/2025. However, I (SI of Police) will re-open the case as and when clues are obtained”. 3. Written instructions dated 22.04.2026 of Sub-Inspector of Police, Thondangi Police Station, Kakinada District, is made part of the record. 4. At that juncture, learned counsel for petitioner seeks permission of this Court to withdraw the present writ petition to work out his legal remedies in accordance with law. 5. Permission is accorded. 6. Accordingly, writ petition is dismissed as withdrawn. However, it is made clear that all the remedies are left open to the respective parties to proceed, in accordance with the law.
