The petitioner, above-named, is in custody in connection with Giridih (M) P.S. Case No. 16 of 2025 for the offence registered under Sections 64/ 351(2) of BNS, 2023 has prayed for regular bail. As per the prosecution case, It is submitted by the learned counsel on behalf of petitioner that the victim/ lady is major, aged 32 years and the present FIR has been lodged against the petitioner [aged about 23 years old], three years after the alleged incidence, the instant FIR has been lodged. It is further submitted that consensual relationship is apparent from the very fact that the same continued uninterrupted for three years and no complaint was made to any quarter. Learned A.P.P. for the State has opposed the prayer for bail. The argument advanced on behalf of the petitioner has an element of credence. Accordingly, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
