JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question an order dated 31.08.2024 insofar as it imposes the condition of surety while allowing an application under Sections 451 and 457 of the Cr.P.C. directing defreezement of the account of the petitioner. 2. Heard the learned counsel, Ms. Keerthi Reddy, appearing for the petitioner, Sri. Anoop Kumar, learned HCGP appearing for respondent No.1 and have perused the material on record. 3. The petitioner is not the accused in the crime nor is an accused while filing the charge sheet in Crime No.150/2023, but the account of the petitioner stood frozen owing to certain money trail. The petitioner then files an application before the concerned Court invoking provisions under Sections 451 and 457 of the Cr.P.C. The concerned Court allows the application by the following order: - 4 - HC-KAR NC: 2026:KHC:16366 CRL.P No. 7375 of 2025 "ORDER The application under section 451 and 457 of Cr.PC filed by the applicant M/s. Blue Marlin Container Line Pvt. Ltd., represented by its Managing Director Mr. Mukesh Pasari is hereby allowed. The I.O. is directed to defreeze the Axis Bank Ltd., Account bearing No.918020044957274. The applicant shall execute indemnity bond of Rs.10,00,000/- with one surety for like sum with the conditions is mentioned as under." 4. Learned counsel appearing for the petitioner submits that the petitioner is ready and willing to offer surety, but the said surety is not being accepted by the concerned Court for defreezement of the account. 5. The submission of the learned counsel appearing for the petitioner as observed hereinabove is the surety affidavit that is rendered is not being accepted on the score that it is an Agreement of Sale. 6. In that light, I deem it appropriate to direct or permit the petitioner to offer surety, which is free from encumbrance of anywhere in the country for the purpose of defreezing of the account. - 5 - HC-KAR NC: 2026:KHC:16366 CRL.P No. 7375 of 2025 7. In the event the said surety is produced in terms of the order, the Investigating Officer shall forthwith direct defreezement of the account without brooking any further delay.
