ORDER:
This writ petition is filed by the petitioners to direct the respondent Nos.3 and 4 not to interfere in the civil disputes in respect of the suit in O.S.No.215 of 2024 on the file of the learned Civil Judge (Junior Division), Dharmavaram.
2. Case of the petitioners is thus:
That due to disputes between petitioners and respondent Nos.5 to 8 and others filed suit in O.S.No.215 of 2024, seeking partition of lands in an extent of Acs.3.67 cents and 2.44 cents in Sy.Nos.502-1 and 502-2 respectively of Kanumukkala Village, Chennekothapalli Mandal, against the petitioners and the same is pending on the file of the learned Junior Civil Judge (Junior Division), Dharmavaram. Though there are civil disputes, respondent Nos.3 and 4 are frequently instructing the petitioners to settle the matter, at the instance of political leaders and also giving threats to the petitioners to yield their request so as to help the respondent Nos.5 to 12. Though the petitioners informed to the police that civil dispute is pending, they have been continuously harassing the petitioners.

Learned Assistant Government Pleader for Home filed written instructions stating that there are civil disputes among both the parties and basing on the reports of the petitioners as well as respondents, two cases in Crime No.289 of 2023 of the offences under Sections 427, 354-b, 324, 323, 506 r/w 34 of the Indian Penal Code (hereinafter referred to as ‘the Code’) and Crime No.23 of 2024 of the offences under Sections 427, 355, 428 r/w 34 IPC are registered and after completion of investigation, the investigating officer laid charge sheets in both the matters and the same are registered as C.C.Nos.405 of 2023 & 530 of 2024 respectively on the file of the learned

Judicial Magistrate of First Class, Dharmavaram. Further, they never called the petitioners to the police station and never involved in the civil disputes.
4. Heard Sri S. Mahendra,
learned counsel representing Sri N. Aswartha Narayana, learned counsel for the petitioners, Sri O. Udaya Kumar, learned counsel for the respondent Nos.5 to 10 and Sri K. Mallikharjuna Rao, learned Assistant Government Pleader for Home.

Learned counsel for the petitioners submitted that the writ petition may be disposed of by directing the respondent police not to interfere with the civil disputes between the petitioners and respondents. 6. Learned Assistant Government Pleader for Home submitted that, the respondent police have neither called the petitioners nor threatened them to settle the matter. 7. Admittedly, there are civil disputes between both the parties, who are known to each other. Some of the respondents filed suit in O.S.No.215 of 2024, seeking partition of lands in an extent of Acs.3.67 cents and 2.44 cents in Sy.Nos.502-1 and 502-2 respectively of Kanumukkala Village, Chennekothapalli Mandal, against the petitioners and the same is pending on the file of the learned Junior Civil Judge (Junior Division), Dharmavaram. In this regard, it is to be mentioned that it is well settled that police cannot interfere in civil disputes and the Hon’ble Apex Court repeatedly held that when the dispute is purely of civil nature, jurisdiction under Article 226 of the Constitution cannot be exercised and further, when the dispute between two citizens is of civil nature and no crime is registered, police have no jurisdiction to interfere in the civil dispute. It is also settled that in the scheme of Constitution of India, duty to resolve civil dispute is entrusted to judiciary and police have no such power and involvement of police in a pending civil dispute or potential civil dispute between two citizens or two groups of citizens is not within the provisions of the police. 6 SUN, J W.P.No.26442 of 2024
8. Learned Assistant Government Pleader submitted that the police would not interfere in the civil disputes pending between the petitioners and respondents. Having considered the undertaking given by the police that they won’t interfere in the civil disputes, except in accordance with law, this court is of the considered view that this writ petition may be disposed of. 9. In the result, this Writ Petition is disposed of with a direction to respondent Nos.2 to 4 not to interfere with the civil disputes pending between the petitioners and the respondents except in accordance with law, that too, in the criminal cases which are pending on the file of the learned Judicial Magistrate of First Class, Dharmavaram.
It is made clear that this order shall not prevent the respondent Nos.2 to 4 from taking any action strictly in accordance with law if the facts and circumstances warrant such action.
