Heard learned counsel for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 103 and 238 of Bharatiya Nyaya Sanhita (BNS), 2023 in connection with Kurdeg P.S. Case No. 18/2025. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is not named in the F.I.R. He further submits that the petitioner is having no criminal antecedent and there is no eye witness to the incident. He further submits that one co-accused person namely Aman Ekka has already been granted bail by this court in B.A. No. 7168 of 2025 and the petitioner for no offence has been languishing in custody since 27.05.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court. 4. Learned A.P.P. opposes the prayer for bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that the petitioner is not named in the F.I.R. and he is having no criminal antecedent and that the co-accused person has already been granted bail and that the petitioner is in custody since 27.05.2025; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Simdega in connection with Kurdeg P.S. Case No. 18/2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
