JUSTICE M G UMA ORAL ORDER The petitioner being accused No.1 in S.C.No.773/2025 pending on the file of the learned XLV Addl. City Civil and Sessions Judge, Bangalore (CCH-46) (Cr.No.127/2024 of Bommanahalli Police Station), registered for the offence punishable under Section 306 of IPC, has filed this petition seeking for relaxation of the bail condition that was imposed while enlarging him on bail vide order dated 07.06.2024 passed in Crl.P.No.4063/2024. 2. Heard Sri. Vinod N, learned counsel for the petitioner and Sri. Rangaswamy R, learned High Court Government Pleader for the respondent - State. Perused the materials on record. 3. In view of the contentions urged by the learned counsel for the respective parties, the point that would arise for my consideration is: “Whether the petitioner is entitled for the relaxation of the bail condition of the order dated 07.06.2024 passed in Crl.P.No.4063/2024 ?” - 3 - HC-KAR NC: 2026:KHC:10641 CRL.P No. 2245 of 2026 My answer to the above point is in ‘Affirmative’ for the following: R E A S O N S 4. It is the contention of learned counsel for the petitioner that the petitioner/accused No.1 was apprehended and subsequently, he was enlarged on bail by this Court vide order dated 07.06.2024 passed in Crl.P.No.4063/2024. The petitioner has complied with the conditions imposed by this Court at the time of his release on bail. However, now the matter is committed to the Sessions Court and that the petitioner is not in a position to offer two sureties as ordered by this Court. Therefore, he prays for relaxation of this condition, seeking permission to offer only one surety, while keeping the other conditions of the order intact. 5. Learned HCGP for the respondent-State, on instructions, submits that there is no instance of the petitioner violating any of the conditions imposed by this Court on 07.06.2024 in Crl.P. No. 4063/2024. Under the facts and circumstances of the case, I am of the opinion that the condition to furnish two sureties, as ordered by this Court in - 4 - HC-KAR NC: 2026:KHC:10641 CRL.P No. 2245 of 2026 the aforesaid criminal petition, may be relaxed by permitting the petitioner to offer only one surety, as per the other directions in the earlier order. 6. Accordingly, I answer the above point in the affirmative and I proceed to pass the following: ORDER i. The petition is allowed. ii. The condition imposed by this Court on 07.06.2024 passed in Crl.P.No.4063/2024 is modified/relaxed as under: iii. The petitioner is ordered to be enlarged on bail in Cr.No.127/2024 of Bommanahalli Police Station, on obtaining the bond in a sum of Rs.2,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court, subject to other conditions which have mentioned in the said order.
