Order On Board 1.5.2026 1) By way of this petition, petitioner has sought following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner from the respondents in the interest of justice. 10.2 That the Hon'ble Court may be kind enough to issue an appropriate writ/order/direction against respondents including the writ of mandamus
2 directing the respondent authorities to provide the Compassionate Appointment to the petitioner. And/or That the Hon'ble Court may be kind enough to issue an appropriate writ/order/direction to the respondents particularly to respondent no.2 & 3 to decide the pending application for compassionate appointment, at earliest. 10.3 That the Hon'ble Court may be kind enough to issue an appropriate writ/order/direction to the respondents particularly to respondent no.2 and 3 to pay for the appropriate and reasonable damages/compensation to the Petitioner for the damage caused to them due to violation of their fundamental right and the mental trauma & harassment cause to them due to illegal and arbitrary acts of Respondents. 10.4 Any other relief which the Hon'ble Court deems fit under the facts and circumstances of the case may kindly be granted to the petitioner. 2) Learned counsel for the petitioner submits that petitioner’s father namely Mohan Lal Sahu, who was working on the post of Principal in the respondent department died in harness on
17.10.2019. He further submits that petitioner who is the daughter of deceased government servant moved applications for grant of compassionate appointment on 30.1.2020 and 31.1.2022 but till date, those applications have not been decided by the respondent authorities. He contends that respondents No. 3 and 4 may be
directed to the decide the pending applications of the petitioner expeditiously. 3) On the other hand, learned State counsel would oppose. 4) Heard. 5) Taking into consideration the fact that applications moved by the petitioner in the years 2020 and 2022 have not been decided till
3 date, this petition is hereby being disposed directing District Education Officer, Gariyaband and Block Education Officer, Block Fingeshwar, Dist Gariyaband to decide the pending applications dated 30.1.2020 and 31.1.2022 (Annexures P/2 and P/3) strictly in accordance with the law, preferably within a period of 120 days from the date of receipt of copy of this order. 6) With the aforesaid direction, this petition stands disposed.
