JUSTICE BIPIN GUPTA Judgment / Order 24/07/2026 1. The present bail applications have been filed under Section 483 of BNSS, 2023 against the order dated 25.04.2026 passed by the learned Additional District and Sessions Nagar, District Deeg qua accused-petitioners namely Wajib, Asam and Sapat and order dated 07.05.2026 passed by learned Additional District and Sessions Brijnagar, District Deeg, qua accused-petitioners namely [2026:RJ-JP:28563] (3 of 5) [CRLMB-7955/2026] Saddik, Munsaid, Rahil and Nassar in Criminal Misc. Case (CIS) No. 232/2026, 266/2026, 262/2026 and 258/2026 respectively, whereby the bail applications of the petitioners were rejected in connection with F.I.R. No.96/2026, Police Station Nagar, District Deeg for the offences under Section 4/8 of Rajasthan Bovine Animal (Prohibition of Slaughter And Regulation of Temporary Migration or Export) Act, 1995. 2. Learned counsel for the petitioners submits that the petitioners - Saddik & Munsaid @ Sulli are in custody since 30.04.2026. As regards petitioner - Munsaid, two criminal cases are pending against him, one of which is of a similar nature. 3. Learned counsel for the petitioners submits that petitioners - Wajib & Sapat are in custody since 15.04.2026. There are no criminal antecedents against petitioner Wajib of having committed any offence of a similar nature or any other nature in the past. As regards petitioner Sapat, one criminal case is pending against him, which is of a different nature. 4. Learned counsel for the petitioners further submits that petitioners-Asam is in custody since 10.04.2026 and two criminal cases are pending against him, both of which are of a different nature. 5. Learned counsel for the petitioners also submits that petitioners - Rahil & Nassar are in custody since 27.04.2026. There are no criminal antecedents against petitioner - Rahil of having committed any offence of similar nature or any other nature in the past. As regards petitioner Nassar, four criminal cases are pending against him, all of which are of a different nature. [2026:RJ-JP:28563] (4 of 5) [CRLMB-7955/2026] 6. Learned counsel for the petitioners further submits that the challan in the case has already been filed, offences are triable by Magistrate and the trial will take considerable time. Therefore, he prays that the petitioners may be enlarged on bail. 7. Learned Public Prosecutor vehemently opposes the present bail applications. 8. Heard learned counsel for the petitioners as well as the learned Public Prosecutor and perused the material available on record. 9. Without expressing any opinion on the merits of the case and upon consideration of the fact and looking to the custody of the petitioners; offences are triable by Magistrate; the challan has been filed; trial will take considerable time, even though criminal antecedents against the petitioners are recorded but the majority are offences of different nature and qua certain petitioners no criminal antecedents are recorded, therefore, this Court is of the opinion that the bail applications filed by the petitioners deserve to be accepted subject to imposition of stringent conditions. 10. Consequently, the bail applications are allowed. It is ordered that the accused-petitioners namely-(i) Saddik S/o Mamla (ii)Munsaid @ Sulli S/o Usman (iii)Wajib S/o Sahabuddin (iv)Asam S/o Gafur (v)Sapat S/o Abdul Karim (vi)Rahil S/o Ayub (vii) Nassar S/o Rahmat arrested in connection with F.I.R. No.96/2026, Police Station Nagar, District Deeg shall be released on bail; provided each of them furnish a personal bond of Rs.1,00,000/- (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court, with the stipulation that [2026:RJ-JP:28563] (5 of 5) [CRLMB-7955/2026] they shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions: (i) The petitioners shall not leave country without the permission of the Court; (ii) The petitioners shall not commit any offence similar to the offence of which they are accused, or suspected, of the commission of which they are suspected; (iii) The petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence; and (iv) In the event the petitioners are found involved in any other case of similar nature in the future, the prosecution shall be at liberty to move an appropriate application before the learned trial Court for cancellation of the bail granted herein. (v) The accused-petitioners shall mark their presence before the concerned police station once in a month as fixed by the Investigating Officer and a register shall be maintained for the same by Investigating Officer. (vi) In case of any change of residential address, the accused-petitioners shall immediately inform the Investigating Officer as well as the trial Court. (BIPIN GUPTA),J Sudha/25-29
