Kausik (Allowed) CRM (M) 2048 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Electronic Complex Police Station Case No. 252 of 2024 dated 04.12.2024 under sections 64(i) of the BNS, 2023 read with sections 4/6 of POCSO Act. And In the matter of : Preetam Biswas @ Pritam Biswas ……Petitioner. Mr. Aniruddha Bhattacharyya Ms. Rai Das Mr. Uttam Mukherjee Ms. A. Bose ……for the Petitioner. Mr. Ashok Das ……for the State. Affidavit of service filed be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 2 months and the evidence of the victim has already been concluded. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS. I have taken into account the statement of the victim, the deposition of the victim, the medical evidence which is appearing and the overall circumstances. Having regard to the 2 present stage of the case and the period of detention, I am of the view further incarceration of the petitioner is unwarranted. As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Preetam Biswas @ Pritam Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court (under POCSO Act), Barasat, 24 Parganas North. If on bail petitioner shall be physically present on each and every date fixed by the learned Special Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the learned Special Court. Additionally petitioner shall not enter the jurisdiction of Electronic Complex Police Station without prior permission of the Learned Special Court. Accordingly, CRM (M) 2048 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
