ORDER: This writ petition is filed to declare the action of the respondents in not releasing the admitted bills for the works executed by the petitioner namely (i) agreement vide Lr.Rc.No. ATO / GGMP / Allavaripalem / 2023-24, dated 20.01.2024 for providing C.C. road of Bala Bapi Reddy House to new Grama Sachivalayam building in Pittupalem area in Allavaripalem Village of Cherukupalli Mandal Bapatla District with an estimated cost of Rs. 11 00 Lakhs and approved an amount of Rs. 8,16,215/- ii) agreement vide Lr.Rc.No. ATO / GGMP Allavaripalem / 2023-24 dated 20.01.2024 for Construction of C.C. road from R and B road to Health Wellness Center Allavaripalem Village of Cherukupalli Mandal Bapatla District with an estimated cost of Rs. 5.60 Lakhs and approved an amount of Rs. 4,62,175/- (iii) agreement vide Lr.Rc.No. ATO / GGMP / Allavaripalem / 2023-24, dated 20.01.2024 for construction of C.C. road in Kuretipalem Main Road in Allavaripalem Village of Cherukupalli Mandal, Bapatla District with an estimated cost of Rs.3.40 Lakhs, totalling an amount of Rs.15,59,809/-, as illegal arbitrary and consequently, direct the respondent authorities to release the admitted amount of Rs.15,59,809/- with interest at 18% to the petitioner. 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 3 BSB,J W.P. No.25130 of 2026

On the other hand, learned Assistant Government Pleader for Gram Panchayat and Rural Development, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the Executive Engineer, PRI PIU Division, Bapatla, vide Lr.RC.No.A3 / Court Cases / 2026, dated 08.09.2026, stating that balance net amount of Rs.16,82,976/- would be paid to the petitioner as and when the government releases the funds. 04. The learned counsel for the petitioner requested to pass appropriate order for the payment of the amount admitted in the written instructions. 05. In view of the submissions made on both sides, the writ petition is disposed of, directing the respondents to pay an amount of Rs.16,82,976/- (sixteen lakh eighty two thousand nine hundred seventy six rupees only) to the petitioner, along with the interest, if any, at the rate entitled, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. There shall be no order as to costs.
