Order No.03 Dated- 18.02.2026
Heard the parties. The petitioner has moved this Court for grant of bail in connection with S.T. No. 68 of 2025 arising out of Basantrai P.S. Case No.50 of 2024 registered for the offences punishable under sections 103/3(5) of the B.N.S., 2023 and under Section 3/4 of D.P. Act but charge has been framed under Section 80/3(5) of B.N.S.,
2023. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed the murder of his own wife in furtherance of common intention with the co-accused persons because of non-fulfilment of demand of dowry. It is further submitted that the allegations against the petitioner are all false and the sole eyewitness of the occurrence being the minor son of the petitioner is a tutored witness. It is then submitted that the petitioner has no idea as to whether the said son of the petitioner, who was four-year-old at time of occurrence, has been examined as witness or not but so far six witnesses have been examined by the prosecution in the trial. It is next submitted that postmortem report goes to show that the cause of death was probably due to asphyxia due to hanging and there is no external injury on the body of the deceased. It is also
submitted that the father and mother of the petitioner have already been admitted to bail. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner of committing murder of his wife by throttling her neck. It is then submitted by learned Addl. P.P. that the six prosecution witnesses examined during the trial have supported the case of the prosecution and in view of the overwhelming evidence in the record, there is every chance of the petitioner absconding if released on bail to evade serving out the sentence which is likely to be imposed upon his conviction. Hence, it is submitted that the petitioner ought not be admitted to bail.
Considering the serious nature of allegation against the petitioner and the chance of the petitioner absconding if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail at this stage. Accordingly, the prayer for bail of the abovenamed petitioner is rejected. (Anil Kumar Choudhary, J.)
