Heard on I.A. No. 04/2026 which is an application for withdrawal of the writ petition. 2. This case was listed on 19.03.2026 on an application for withdrawal of the writ petition. On the said date, Mr. Mirza Hafeez Baig, the counsel who was initially engaged by the petitioner appeared before this Court and when it was apprised to Mr. Mirza Hafeez Baig that an application has been filed for withdrawal of the writ petition, he made statement before the Court that he has no instructions. He also submitted that just a day ago, he had a talk with the petitioner and he has not given any instructions to him for withdrawal of the writ petition. 3. Upon perusal of the record, it revealed that the application for withdrawal of the writ petition was filed by Mr. V.K. Pandey, Advocate along with the affidavit of petitioner. It also revealed that the petitioner has also filed the application seeking permission to engage another counsel which too also, was supported by an Affidavit. 4. In the above facts of the case and further considering that Mr. V.K. Pandey or his office colleague did not appear before this Court nor the petitioner’s, case is fixed for hearing in this week. Today, Mr. Mirza Hafeez Baig, Advocate is not present. This case was taken up for hearing in pre- lunch session. At that time also, he did not appear and when the case is taken up for hearing in the post-lunch session also, he is not present. 5. Along with Mr. T.R. Chandrakar, Advocate who is from the office of Mr. V.K. Pandey, Advocate, petitioner is also present in person. Petitioner submitted that he has engaged Mr. V.K. Pandey as Advocate, filed an application seeking to engage another counsel and have also filed an 3 application for withdrawal of the writ petition with liberty to file better constituted petition. 6. In the aforementioned facts of the case and the submission of the petitioner in person appearing before this Court along with Mr. T.R. Chandrakar, Advocate, the application I.A. No. 04/2026 which is an application for withdraw of the writ petition is allowed and petitioner is permitted to withdraw this writ petition with liberty to file better petition. 7.
