Feeling aggrieved by the judgment and award dated 11.08.2011 passed by the learned Joint Civil Judge, Senior Division, Omerga in Land Acquisition Reference No.25 of 2008 (Old No.158 of 2002), the claimants have filed the First Appeal seeking enhancement in compensation. The First Appeal is under delay. During the pendency of proceedings, original claimant namely Ravan More expired. This Civil Application is filed by legal representatives of deceased Ravan More for getting themselves arrayed in the First Appeal. There is delay of 1229 days caused in filing this application. 2 11 CA 10778 OF 2026 reasons for explaining the delay are mentioned at paragraph Nos.2 to 4 of the application.
2. Mr. V. V. Ingole, learned Advocate for the applicants submits that the applicants are ready to waive the interest for the delayed period.
3. Learned AGP for the respondent – State prays to pass appropriate order.
4. For the reasons stated in the application, the same is allowed. Delay caused in filing the application stands condoned. Abatement, if any, is quashed and set aside.
5. The applicants are permitted to amend the title clause of the First Appeal and applications therein, if any, by incorporating their names as legal representatives of deceased claimant Ravan More.
6. Let the amendment be carried out within a period of four weeks from today.
7. Civil Application stands disposed of accordingly.
