THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO.30568 OF 2013 ORDER:-
1. This writ petition is filed under Article 226 of the Constitution of India, claiming the following direction:
“to pass an order or orders or direction more particularly one in the nature of a writ of mandamus declaring the action of respondents 1 to 4 in levying and demanding minimum demand charges 80 of CMD over and above the actual demand supplied from the petitioner company for the power availed during the power restrictions imposed by the respondents from January 2012 to November 2012 as arbitrary illegal contrary to the judgments of Apex Court besides violating the petitioners right guaranteed under Article 14 19 1 g 300A of Constitution of India and consequently direct the Respondents 1 to 3 to refund the amount of Rs 85 00 665/ with interest to the petitioner company by way of adjustment in the CC Bills and to pass”
2. Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents. 3. The case of the petitioner is that the respondents 1 to 4 are demanding minimum demand charges @ 80% of CMD over and above the actual demand supplied from the petitioner company for the power availed during the power restrictions imposed by the respondents from January-2012 to November-2012 and demanded for recovery of Rs.85,00,665/- along with interest to the petitioner. Challenging the same, the present Writ Petition is filed. 4. On the other hand, learned Standing Counsel appearing for the respondents furnished the Written instructions dated submitted by the Senior Accounts Officer, Operation Circle, APSPDC Ltd, wherein it is stated as here under:- a) Consumer has filed the Writ Petition on demanding of the Minimum demand charges during Power Restriction period for the period from January 2012 to November 2012. Consumer has represented this office, to refund an amount of Rs.8500665/- by way of adjustment in the CC Bills. 4
b) On verification of the Consumer Ledger the Petitioners Company has applied for the Dismantle of the service during April'2020 after adjusting of all the amounts from the available security deposit.
c) As per the request of the consumer the service was dismantled duly adjusting of all amounts from the available security deposit. 5. Learned Standing Counsel submits that the service connection of the petitioner has already been dismantled after duly adjusting all amounts from the available security deposit and there is no demand pending against the petitioner. Therefore, no further orders are required to be passed in this writ petition. 6. In view of the aforesaid submission, writ petition is closed. No costs. 7.
