The Court made the following order:
Heard Sri P. Nanilu Naidu, learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and Sri A.S.C.Bose, learned Standing Counsel for Municipal Corporation appearing for respondent Nos.2 and 3. 2. The grievance of the petitioner in the instant Writ Petition is against the action of respondent Nos.2 to 3 in not considering the representation of the petitioner submitted by her seeking mutation of the subject property bearing D.No.49-8-7/2, Lalitha Nagar, Akkayyapalem, Visakhapatnam, in her name. 3. Learned counsel for the petitioner contends that she has succeeded to the subject property belonging to her late husband, Sri M. Srinivasa Reddy. It is contended that during the lifetime of the petitioner’s husband, Sri M. Srinivasa Reddy, he executed and registered a Will Deed dated 30.04.2019 in favour of the petitioner. After the demise of the petitioner’s husband, the petitioner approached the respondent authorities by way of a representation dated 16.07.2026, seeking transfer and mutation of the subject property in favour of the petitioner. However, the respondent authorities have not passed any orders. Hence, the petitioner has approached this Court by way of the present writ petition. 4. Learned Standing Counsel for the Municipal Corporation appearing for respondent Nos.2 and 3, brought to the notice of this Court that the
3
representation stated that it was sent by registered post.
He further submitted that the petitioner must submit an application in the prescribed format and proper form before the Corporation. Upon payment of the requisite fee, the Corporation would consider it in accordance with law. He further submitted that the respondent authorities would not consider any representation sent by post. 5. Having regard to the same, this Court deems it appropriate to dispose of the writ petition, granting liberty to the petitioner to approach the respondent authorities by filing an appropriate application in the prescribed form, in accordance with law. Upon filing of such an application, the respondent authorities are directed to consider the same and pass appropriate orders, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Dated: 15.09.2026 BSK
