JUSTICE R.K. PATTANAIK Order No. ORDER 28.01.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R Case No.2183 of 2025 pending in the file of learned S.D.J.M., Jagatsingpur arising out of Balikuda P.S. Case No.569 dated 25th December, 2025 on the grounds stated. 3. Perused the FIR as at Annexure-1. On a reading of the same, the Court finds that some of the members of a religious organization arrived at the spot in a grand rally and allegedly committed the excess described therein. The petitioner is claimed to have no other similar antecedent. Recorded the objection of the State. No one has been named in the FIR. The allegation is that some members of the named religious organization did the mischief and damaged the Musjid. It is claimed that no serious damage has been caused to the Musjid as claimed in the FIR i.e. Annexure-1. Recording the submissions as above, this Court is of the view that the petitioner, who is a young boy aged about 21 years, claiming to have no past criminal antecedent, should be directed to surrender before the learned court below for being released on bail with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M., Jagatsingpur within a fortnight from today, it is directed that he shall be released on bail in connection with G.R Case No.2183 of 2025 corresponding to Balikuda P.S. Case No.569 dated 25th December, 2025 with conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case. 6.
