The petitioners are aggrieved by the declaration of surcharge under Section 60 of the Andhra Pradesh Cooperative Societies Act, vide Rc.Nos.1 to 8/895/2004-C, dated 24.05.2005, and the consequential relieving certificate issued by respondent No.4 on 31.10.2014, which are under challenge in the present writ petitions. 2. This Court, while admitting the writ petitions, suspended the surcharge proceedings dated 24.05.2005 issued by respondent No.3, vide orders dated 12.02.2014 in W.P.No.3960 of 2014 and 28.03.2014 in W.P.No.9464 of 2014. 3. The learned counsel appearing for the petitioners submits that the surcharge proceedings were issued against the President and other members, including the petitioners. It is submitted that similar proceedings were challenged in W.P.No.2438 of 2006 by the President of the Society, who challenged the proceedings initiated against him, and this Court, vide order dated 14.02.2018, set aside the impugned proceedings. The order passed in W.P.No.2438 of 2006 was also considered while setting aside similar proceedings in W.P.No.11847 of 2006, and the impugned proceedings therein were set aside by the learned Single Judge of this Court on 26.02.2020. 4. It is submitted that the petitioners are also members who are aggrieved by the impugned proceedings, which have already been set aside by 5 this Court. Considering the same and following the order passed by the learned Single Judge of this Court in W.P.No.2438 of 2006, the present writ petitions are allowed. There shall be no order as to costs. 5. Accordingly, the writ petitions are disposed of. There shall be no order as to costs.
