LEONARD ARUL JOSEPH SELVAM ADDITIONAL PP FOR R1 __________ Page1 of 5 https://www.mhc.tn.gov.in/judis CRL OP No. 5814 of 2026 ORDER The petitioner, who is facing trial in C.C.No.788 of 2022 for the offence under Sections 143, 294(b), 267, 506(i) IPC, filed the present quash petition seeking to quash the proceedings. 2. The case of the prosecution is that, on the night intervening between 29.03.2022 and 30.03.2022 at about 12.30 a.m., when the respondent Police were on patrol duty at MC Road, J.P.Koil Junction opposite to Anandham Gold Covering Shop, the petitioner and other accused persons had assembled in a drunken state, and parked their vehicle in the middle of the road. When the first respondent directed them to disperse, they stated that their brother, Jagadeesan, is a Corporation Counsellor and no action could be taken against them. They also scolded the second respondent. and The second respondent videographed the said incident. Thereafter, based on the complaint of the second respondent, the present case was registered. 3. The contention of the petitioner is that the petitioner's name does not find place in the complaint and the FIR. The complaint is only directed against the Councillor Jagadeesan and five unidentified persons. The petitioner’s name has been roped in without any test identification parade. Further, there is no specific allegation against the petitioner and only on the basis of vague and omnibus allegations, the petitioner has been included in this case. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis CRL OP No. 5814 of 2026 4. It is the further contention of the petitioner that the alleged incident took place at 12.30 a.m. on the night intervening between 29.03.2022 and 30.03.2022. However, the FIR was registered only at 18.45 hours on 30.03.2022. There is a delay of about 18 hours in registering the FIR, but no reason has been given for the said delay. Ingredients of the offences under Sections 143, 294(b), 353 & 506(i) IPC are not made out. Hence, prayed for quashing the said proceedings. 5. Per contra, the learned Additional Public Prosecutor filed counter affidavit and submitted that the second respondent has videographed the entire incident and the Investigating Officer has identified the persons involved in the crime. Accordingly, the petitioner name was arrayed as an accused in this case. The said video recording has been produced along with the final report, and the investigation has clearly established the involvement of the petitioner in the commission of the offence. 6. This Court has considered the submissions made on either side and perused the materials available on record. It is to be seen that in the video recording, the petitioner had used abusive language against the police officials and had also threatened them while they were discharging their official duties. Therefore, this Court is not inclined to entertain this petition. 7. Accordingly, this Criminal Original Petition is dismissed. It is made clear that the observations made herein are only for the purpose of deciding this petition and the Trial Court shall proceed with the case independently on its own merits uninfluenced by any observations made in this order.
