By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to quash impugned seniority list dated 25.09.2019 (Annexure P-1) issued by the respondent SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.03.23 14:24:21 +0530 2 authorities in respect of the petitioner and his junior respondent no. 4 and 5, in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents authorities to prepare and issue new seniority list on the post of Lecturer as on 02.12.2014 in respect of the petitioner and his junior employee respondent no. 4 and 5 by amending impugned seniority list (Annexure P-1), in the interest of justice. 10.3 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. Ms. Khan would submit that the petitioner was appointed to the post of Assistant Teacher on 31.03.1987, whereas respondents No. 4 & 5 were appointed on 09.12.1993 and 22.08.1989 respectively. She would submit that the petitioner was promoted to the post of Lecturer vide order dated 30.05.2017 and the seniority list of Lecturers was published on 25.09.2019 with effect from 01.04.2019, wherein name of the petitioner has been placed at serial No. 2852, whereas names of private respondents have been placed at serial Nos. 1875 and 1309 respectively. She would submit that the petitioner was promoted to the post of Lecturer prior to the private respondents. She would submit that private respondents entered in the department after appointment of the petitioner, and therefore, name of the petitioner should be kept above and over to private respondents. 3. On the other hand, Mr. Ojha would submit that the petitioner was promoted to the post of Lecturer vide order dated 30.05.2017, but he failed to comply with the said order, therefore, he has been placed below the private respondents. 4. Heard. 3 5. Taking into consideration the fact that the petitioner entered in the service prior to the private respondents, but names of private respondents have been placed above and over to the petitioner and further looking to the dispute involved in the present case, this petition is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No. 2, and in turn, the said authority is directed to decide it expeditiously, preferably within a period of 120 days. It is made clear that this Court has not expressed any opinion on the merits of the case. 6. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of.
