During the course of hearing, learned counsel for the petitioners has submitted that the Truck bearing registration No. HP62D-2072 is lying idle and is losing its value day by day, therefore, he prayed that the vehicle in question be sold and the sale proceeds thereof be deposited before the learned Trial Court. This would be beneficial to both parties at the time of the conclusion of the trial by the learned Trial Court.

Learned Additional Advocate General for the respondent/State submits that he has no objection in case the vehicle in question is sold and the sale proceeds thereof are deposited in the learned Trial Court.

In view of above, the present petition is allowed and the vehicle, i.e. Truck bearing registration No. HP62D-2072, which was impounded in connection with F.I.R. No. 0069 of 2021, dated 20.05.2021, for the commission of offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, registered at Police Station Sadar Solan, District Solan, H.P. is ordered to be sold by way of public auction and the sale proceeds thereof shall be deposited before the learned Trial Court.

It clarified that the outcome of the trial shall determine whether the sale proceeds are to be released in favour of the petitioners or confiscated to the State. The petitioners are at liberty produce prospective buyers before the competent authority conducting the auction proceedings so as to ensure that the maximum possible price of the vehicle in question is secured.

The petition is disposed of in the aforesaid terms, so also the pending applications, if any.
